Terms of Service

These Terms of Service govern the use of services provided by JackServers, including bare metal and dedicated server services.

Please read these Terms carefully. By ordering, accessing, or using any JackServers service, you acknowledge that you have read and understood these Terms and agree to be bound by them. Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted under applicable law.

1. Definitions

For the purposes of these Terms:

  • "JackServers" means the service provider operating the JackServers website and services.
  • "Customer" means any individual or legal entity that creates an account or purchases a service from JackServers.
  • "Services" means bare metal servers, dedicated servers, network services, IP resources, support services, and other services offered by JackServers.
  • "Server" means a physical dedicated server provisioned for a Customer.
  • "Account" means the Customer account created through the JackServers website.

2. Eligibility and Accounts

Customers must provide accurate and complete information when creating an account or placing an order.

You are responsible for maintaining the confidentiality of your account credentials and for all activity performed through your account.

Customers must not create accounts using false identities, misleading information, or information belonging to another person without authorization.

JackServers reserves the right to request additional information for fraud prevention, payment verification, abuse investigation, or legal compliance.

3. Services

JackServers provides bare metal and dedicated server services to customers on a monthly or other billing basis depending on the product selected.

The exact hardware configuration, bandwidth, storage, memory, network connectivity, operating system availability, setup fees, monthly price, and other characteristics are specified on the applicable product or order page.

Hardware configurations and availability may change without notice for future orders.

A server order is not considered fully provisioned until JackServers or its infrastructure provider has completed the provisioning process.

4. Server Provisioning

Provisioning times depend on hardware availability, data center capacity, payment verification, network availability, and other technical circumstances.

An estimated provisioning time is not a guarantee unless expressly stated otherwise in writing by JackServers.

JackServers may substitute equivalent hardware or infrastructure when necessary, provided that the replacement is reasonably comparable to the service ordered.

Server credentials may be delivered electronically to the email address associated with the Customer account.

5. Payments and Billing

All prices displayed on the JackServers website are stated in the currency shown on the applicable product or checkout page.

Unless otherwise specified, recurring server services are billed in advance for each applicable billing period.

JackServers may accept payment methods including PayPal and other payment methods displayed during checkout.

Customers are responsible for providing accurate billing information.

A payment may be subject to verification before a service is provisioned.

JackServers reserves the right to delay or reject an order when a payment appears fraudulent, unauthorized, disputed, or otherwise requires additional verification.

6. Cancellation and Refunds

Customers may request cancellation of a service through their JackServers account or by contacting support.

Cancellation of a recurring service prevents future billing, subject to the applicable billing terms.

Unless otherwise stated for a particular product, prepaid service fees are generally non-refundable once a server has been provisioned and made available to the Customer.

Setup fees, IP allocation fees, installation fees, and other one-time charges may be non-refundable where expressly stated during checkout.

Nothing in this section limits any mandatory refund or cancellation rights that apply under applicable law.

7. Acceptable Use Policy

JackServers services may only be used for lawful purposes and in compliance with these Terms, applicable laws, regulations, and third-party rights.

Customers are responsible for all content, applications, software, accounts, data, and network activity originating from their servers.

Customers must ensure that their use of the Services does not cause harm to JackServers, its infrastructure providers, other customers, networks, or third parties.

8. Prohibited Activities

The following activities are prohibited unless expressly authorized in writing by JackServers and legally permitted:

  • Phishing, credential theft, identity theft, or impersonation.
  • Distribution of malware, ransomware, trojans, viruses, or other malicious software.
  • Fraudulent activity or financial crimes.
  • Unauthorized access to computer systems or networks.
  • Unauthorized vulnerability exploitation.
  • Denial-of-service or distributed denial-of-service attacks.
  • Port scanning or network scanning directed at systems without authorization.
  • Distribution of illegal content.
  • Child sexual abuse material or any content involving exploitation of minors.
  • Spam or unsolicited bulk email.
  • Copyright infringement.
  • Activities intended to bypass security controls or access restrictions.
  • Cryptocurrency mining when prohibited by the applicable service or infrastructure provider.
  • Any activity that violates applicable law.

9. Abuse and Security

JackServers may investigate reports involving abuse, security incidents, malicious activity, or violations of these Terms.

Customers must cooperate reasonably with legitimate abuse and security investigations.

When necessary to protect the network, infrastructure, customers, or third parties, JackServers may temporarily suspend network access or services while an investigation is conducted.

Where reasonably possible, JackServers will attempt to notify the affected Customer before taking action. Immediate action may be taken when required to prevent ongoing harm.

10. Copyright and DMCA Complaints

JackServers respects intellectual property rights.

Copyright holders or authorized representatives may submit copyright infringement complaints containing sufficient information to identify the allegedly infringing material, the affected work, and the requesting party.

JackServers may investigate valid complaints and take appropriate action, which may include notifying the Customer, removing or disabling access to infringing material, or suspending the affected service.

False or abusive copyright complaints may be rejected.

11. Email and Spam

JackServers does not permit the use of its infrastructure for unsolicited bulk email, spam, phishing campaigns, fraudulent messages, or malicious email activity.

Customers operating mail servers are responsible for configuring their systems securely and maintaining appropriate authentication, DNS, reverse DNS, and reputation controls.

A server generating significant spam or malicious email traffic may be subject to immediate network restriction or suspension.

12. Server Administration

Unless a managed service is expressly purchased, bare metal and dedicated servers are generally self-managed.

The Customer is responsible for:

  • Operating system configuration.
  • Software installation and updates.
  • Security patches.
  • Firewall configuration.
  • Application security.
  • User account management.
  • Passwords and authentication.
  • Backups.
  • Monitoring.

JackServers is not responsible for vulnerabilities or security issues resulting from software installed or configured by the Customer.

13. IP Addresses and Network Resources

IP addresses and network resources assigned to a Customer remain subject to the policies of the applicable network and Internet registries.

IP addresses may not be transferred, sold, rented, or advertised as independently owned resources unless expressly authorized.

JackServers may change or reassign IP resources when reasonably necessary due to network operations, abuse, routing, provider requirements, or other technical circumstances.

14. Availability and Maintenance

JackServers aims to provide reliable and continuous service but does not guarantee uninterrupted availability unless a specific service-level agreement applies.

Services may become temporarily unavailable due to maintenance, hardware failure, network incidents, software problems, security events, upstream provider issues, or circumstances beyond the reasonable control of JackServers.

Scheduled maintenance may be announced when reasonably possible.

15. Third-Party Infrastructure

JackServers may use third-party data centers, network providers, hardware providers, payment processors, and other infrastructure partners to provide the Services.

The availability and operation of third-party infrastructure may be outside the direct control of JackServers.

Customers agree that certain service characteristics may be subject to the policies and technical limitations of applicable infrastructure providers.

16. Backups and Data Loss

Unless a backup service is expressly included or purchased, JackServers does not guarantee that Customer data will be backed up.

Customers are responsible for maintaining independent backups of important data.

JackServers is not responsible for data loss caused by hardware failure, software failure, accidental deletion, security incidents, Customer actions, or other circumstances unless otherwise required by applicable law.

17. Suspension and Termination

JackServers may suspend or terminate a service when:

  • The Customer violates these Terms.
  • The Customer engages in abusive or illegal activity.
  • A payment is reversed, disputed, fraudulent, or unauthorized.
  • The Customer creates a significant security or network risk.
  • The Customer fails to pay applicable fees.
  • Suspension is required by law or by an applicable infrastructure provider.

Where appropriate and reasonably possible, JackServers may provide notice and an opportunity to correct the violation before termination.

18. Customer Responsibilities

The Customer is responsible for all activity performed through their account and servers.

The Customer must maintain accurate account information and notify JackServers of unauthorized access or suspected compromise.

Customers must not intentionally circumvent billing, security, authentication, network, or service limitations.

19. Limitation of Liability

To the maximum extent permitted by applicable law, JackServers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use or inability to use the Services.

This includes, where legally permitted, loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

20. Indemnification

To the extent permitted by applicable law, the Customer agrees to indemnify and hold harmless JackServers and its service providers from claims, damages, liabilities, costs, and expenses arising from the Customer's unlawful use of the Services, violation of these Terms, or infringement of third-party rights.

21. Privacy

JackServers may collect and process information necessary to create and manage customer accounts, process payments, provide services, prevent fraud, provide support, and comply with legal obligations.

Personal information will be handled in accordance with the JackServers Privacy Policy.

Customers should avoid submitting unnecessary sensitive personal information through support tickets or contact forms.

22. Changes to These Terms

JackServers may update these Terms from time to time to reflect changes to services, technology, legal requirements, or business operations.

The updated version will be published on this website with an updated effective date.

Continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

23. Applicable Law

JackServers operates from Argentina.

These Terms are intended to be interpreted in accordance with the applicable laws and regulations of Argentina, subject to any mandatory rights or protections that may apply to the Customer under applicable law.

Nothing in these Terms is intended to deprive a consumer of mandatory legal rights available in the jurisdiction where those rights apply.
